These Terms & Conditions ("Terms") govern your access to and use of the Hair Fixing Jobs India platform ("Platform"), operated by Hair Fixing Jobs India. By accessing or using our website at hairfixingjobs.in, mobile applications, or any related services, you agree to be legally bound by these Terms. If you do not agree to these Terms, you must immediately cease all use of the Platform.
1. Acceptance of Terms
By creating an account, browsing listings, submitting applications, posting jobs, or otherwise interacting with the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations.
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or platform notification. Continued use of the Platform after such modifications constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
If you are using the Platform on behalf of a business or entity, you represent and warrant that you have the authority to bind that entity to these Terms.
2. Platform Usage Terms
The Platform is provided solely as a verified job marketplace connecting hair fixing technicians with studios and salons. You agree to use the Platform only for its intended purpose and in compliance with all applicable Indian laws.
Permitted Use
- Searching and applying for jobs
- Posting verified job listings
- Creating truthful professional profiles
- Communicating with matched studios/candidates
- Paying for verified or premium subscriptions
Prohibited Use
- Scraping or data harvesting
- Automated bot registrations
- Impersonating another person or entity
- Transmitting malware or harmful code
- Circumventing Platform fees or security measures
We may monitor Platform usage to detect violations. Any unauthorised access, disruption, or interference with the Platform's infrastructure is strictly prohibited and may result in legal action under the Information Technology Act, 2000.
3. User Responsibilities
All users (staff / technicians) are expected to maintain the highest standards of integrity and professionalism:
- Accurate information — All details provided during registration, profile creation, and job applications must be truthful, current, and complete. Providing false experience, skills, or contact information is a material breach.
- Profile ownership — You may maintain only one active account. Duplicate or alias accounts created to manipulate visibility or deceive studios will be permanently banned.
- Communication conduct — All messages, calls, and interactions with studios must be respectful and professional. Harassment, abuse, or discriminatory language will result in immediate account suspension.
- Job commitment — Once you accept an offer or confirm an interview, you are expected to honour that commitment. Repeated no-shows or last-minute cancellations without valid reason may lead to profile deactivation.
- Document authenticity — Any identity documents, certificates, or portfolios uploaded must be genuine. Photoshopped, borrowed, or forged documents constitute fraud.
You are solely responsible for all activity that occurs under your account. Notify us immediately at hairfixingjobs@gmail.com if you suspect unauthorised access.
4. Studio Responsibilities
Studios, salons, and employers listing jobs on the Platform have additional obligations to ensure a safe and trustworthy environment:
- Truthful listings — Job descriptions, salary ranges, location details, and benefits must accurately reflect the actual position. Bait-and-switch tactics or deliberately misleading postings are prohibited.
- Legal compliance — All hiring practices must comply with Indian labour laws, including minimum wage regulations, working hour limits, and anti-discrimination statutes. Listings must not discriminate on the basis of religion, caste, gender, or place of origin.
- Timely response — Studios should respond to applications within a reasonable timeframe (ideally within 7 days). Ignoring or ghosting candidates creates a poor experience and may affect visibility.
- Safe workplace — Studios must provide a safe, hygienic, and harassment-free working environment. Any verified complaint regarding unsafe conditions will result in immediate suspension pending investigation.
- Subscription honesty — Subscription payments must be made using the studio's own authorised payment method. Chargebacks made in bad faith will result in account termination and potential legal recovery.
Note: Studios found engaging in exploitative practices (withholding salaries, bonded labour, physical abuse, or sexual harassment) will be permanently banned, reported to relevant authorities, and publicly listed in our transparency report.
5. Fake Profile Restrictions
Hair Fixing Jobs India maintains a strict zero-tolerance policy for fake profiles, impersonation, and fraudulent activity:
- Identity impersonation — Creating a profile using someone else's name, photos, or documents is a criminal offence under Section 66C of the IT Act, 2000. Such accounts are banned immediately and may be reported to law enforcement.
- Duplicate listings — Posting the same job multiple times with minor variations to game search rankings is prohibited.
- Misrepresentation of skills — Claiming expertise (e.g., "10 years experience") without substantiation or verification is considered deceptive conduct.
- Shell studios — Registering a studio without a genuine physical business location or with the intent to collect candidate data without hiring is strictly forbidden.
Enforcement: Our verification team cross-checks Aadhaar biometrics, selfie matches, business registration databases, and conducts periodic physical spot-checks. Verified users and studios found violating this policy forfeit all subscription fees, lose their verified badge permanently, and may face civil or criminal liability.
6. Verification Rules
Verification badges are a mark of trust. They are granted subject to strict rules:
- Staff verification — Requires a valid Aadhaar or PAN, a live selfie match, and mobile number verification. The badge reads "Identity Verified" and does not imply skill endorsement.
- Studio verification — Requires GST/MSME registration or a valid shop establishment certificate, physical address confirmation, and owner KYC. The "Verified Studio" badge appears after successful admin review.
- Premium studio — Granted to verified studios that subscribe to a Premium plan. Benefits include priority listing, highlighted badges, and dashboard analytics.
- Document expiry — If a GST registration or business license expires, the studio must upload renewed documents within 30 days or the badge will be revoked.
We reserve the right to revoke any verification badge at our sole discretion if we suspect document forgery, business closure, or policy violation. Verification decisions are final but may be appealed within 14 days with additional supporting documentation.
7. Job Posting Rules
All job listings must meet the following standards to remain active on the Platform:
- Clear role description — Each listing must specify the job title, required skills, experience level, salary range, city, and employment type (full-time, part-time, apprentice, or freelance).
- No discriminatory language — Listings must not exclude candidates based on gender, religion, caste, marital status, age (within legal bounds), or physical appearance.
- Real vacancies only — Phantom jobs posted solely to collect candidate data or for marketing purposes will be removed and the studio may be penalised.
- Salary transparency — Salary ranges must be realistic and inclusive of any commissions or tips. Vague language such as "as per industry standards" without a range is discouraged.
- No external fee solicitation — Studios must not demand placement fees, training deposits, or security bonds from applicants. Such listings are removed immediately and the studio is suspended.
We reserve the right to edit, reject, or remove any job listing that violates these rules or applicable law. Subscription fees are not refunded for listings removed due to policy violations.
8. Account Suspension Policy
We may suspend, restrict, or permanently terminate your account under the following circumstances:
Immediate Suspension
- Fake identity or documents
- Harassment or abuse reports
- Fraudulent payment activity
- Malware or hacking attempts
- Illegal activity (drugs, trafficking)
Graduated Warnings
- Inaccurate profile information
- Repeated job no-shows
- Spam or promotional abuse
- Rude or unprofessional conduct
- Chargeback after service delivery
- Notice — Where feasible, we will notify you via email and in-app alert before suspension, explaining the reason and duration (if temporary).
- Appeals — You may appeal a suspension within 14 days by emailing hairfixingjobs@gmail.com with relevant evidence. Appeals are reviewed within 5 business days.
- Data retention — Suspended account data is retained for 90 days to allow for appeals and dispute resolution, after which it is anonymised or deleted per our Privacy Policy.
- No refunds — Subscription fees are not refunded for accounts suspended due to policy violations. Refunds may be issued only where legally required.
9. Intellectual Property
All intellectual property rights in and to the Platform belong to Hair Fixing Jobs India or our licensors:
- Platform content — Logos, trademarks, text, graphics, software, and databases are protected under Indian copyright and trademark law. You may not copy, modify, distribute, or create derivative works without express written consent.
- User content — By uploading resumes, portfolios, photos, or studio images, you grant us a non-exclusive, royalty-free, worldwide licence to display this content solely for the purpose of operating the Platform. You retain ownership of your original content.
- Feedback — Any suggestions, feature requests, or ideas submitted to us become our property without obligation of compensation or attribution.
If you believe your intellectual property has been infringed on the Platform, please notify us at hairfixingjobs@gmail.com with evidence of ownership and the infringing material. We will respond within 48 hours and remove verified infringing content promptly.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- Platform role — Hair Fixing Jobs India acts solely as an intermediary and marketplace connector. We do not employ staff directly, nor do we guarantee the accuracy of job listings, the suitability of candidates, or the legitimacy of studios.
- No warranty — The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for purpose, or non-infringement.
- Liability cap — Our total aggregate liability to you for any claims arising from or related to the Platform shall not exceed the total amount paid by you to us in the 12 months preceding the claim, or ₹5,000, whichever is higher.
- Excluded damages — We shall not be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or reputational harm, even if advised of the possibility.
- Dispute between users — Any employment dispute, salary non-payment, or workplace issue arising between a studio and a technician is solely between those parties. Hair Fixing Jobs India is not a party to such disputes, though we may mediate informally upon request.
Important: We strongly encourage both studios and candidates to conduct independent due diligence — including in-person interviews, reference checks, and trial periods — before entering into any employment arrangement.
11. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of India. Any dispute arising from or relating to these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation.
If negotiation fails within 30 days, the dispute shall be subject to binding arbitration under the Arbitration and Conciliation Act, 1996, conducted in English by a sole arbitrator appointed by mutual agreement, or failing that, by the Mumbai Centre for International Arbitration (MCIA). The seat of arbitration shall be Mumbai, Maharashtra.
Notwithstanding the above, either party may approach the competent courts in Mumbai for interim injunctive relief to prevent irreparable harm. You consent to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
